In the last few days several users of LastFm posted in their shoutboxes dangerous and offensive sentences. These are offensive attacks to the dignity of individuals and people, of history and peace. These sentences are not only expressions of intolerance and racism, they are explicit political propaganda. Many of the authors of these posts display Nazi-fascist symbols in their pages and are members of last fm groups which openly celebrate the Nazi-fascist ideals. This is illegal in Italy and in many other states. This issue was denounced to last mf several times. There was no answer for a long time. Some moderators then replied and affirmed that there was no reason to intervene. So nothing changed. “All was fine!” However, we believe that there are strong reasons to intervene. The terms of use of LastFm are very clear on the issue.

Upload, post, e-mail, transmit, display, copy, distribute, promote, or otherwise communicate to the public:i. any material that is false, unlawful, threatening, tortious, disparaging (including disparaging of Last.fm, its parent, subsidiaries or affiliates), anything that adversely affects Last.fm such as discouraging any person or entity from advertising with, linking to or supplying Last.fm, abusive, libellous,defamatory, obscene, vulgar, offensive, pornographic, profane, racist, sexually explicit, ethnically or culturally offensive, indecent, or that promotes violence, racial hatred, terrorism, or illegal acts, , or is otherwise objectionable in Last.fm's sole discretion [...]

These are strong words, but ultimately too vague if they do not allow the moderators to intervene against these who are offending others “ethnically or culturally”, against these publishing obscene materials, against the racists and the warmongers, against these furthering hatred. We question the meaning of the words “profane” and “indecent” in the terms of use. What are they referring to? It is important to pin their meaning down, otherwise article 6 will remain too vague and will not be applicable in practice (and in fact it was not enforced by the moderators). It is important to draw a line amongst what can still be considered a tease and the posts which “promotes violence, racial hatred”. As a minimum LastFM should respond to the well founded complaints of the users (being them subscribers or not). LastFM should demonstrate goodwill in responding to this embarrassing precedent.

PETITION

Given the gap amongst the term of use and the actual practice of several users, we demand, with this petition:
1) that the terms of use of this network shall make explicit (in line with the legislation of the so called “civilized” countries) that “offensive” should also refer to content and symbols linked to Nazi:fascist ideology. The superficiality and the indifference to these issues within a space of cultural exchange is alarming, especially when considering that many young people use this space. It is therefore important that it is protected from propaganda and abuse.
2) That these violating the terms of use are punished.
